A si'KtTATi meeting of the above body was held at the Town Board office, Cambridge, on Tuesday evening last. Present : Cra. Wells (chairman), Johnson and Nixon. As they were doubtless aware he had received a communication fiom the solicitors of the Education Board to the effect that they would not allow the laying of new and larger pipes tluough lot 42 (education reserve). With respect to the existing drains the board was anxious to give the Town Boa id all reasonable time to remove the nuisance which is caused by the overflow of this drain upon the lower land adjoining the school ground. Tlnee months were allowed to enable the board to make other and better at range ments. The communication concluded with the intimation that the Education Board was quite determined to put a stop to a nuisance which it had been informed would inevitably lead to much mischief, ' beeausing the bite to become unhealthy. He had looked into the law on the matter and found that section 184, Public Works Act, ISB2, made the diain complained of a jmblic diain; bcction 21 1, Municipal Corporations Act, 1870, \ested the diain in the JJomam Board ; section 222 ot the same Act inflicted a penalty of C2O for stopping or obstiucting a public drain ; suction 219 of the same act empoweicd the board to maku a diain on private land; section 183 gave special poveis beyond the Public Woiks Act; sections 179, 21(5, empowered the boaid to acquire any land within the borough for diainage ; section 10 and 1!) dealt with the procedure for taking lands ; section 228 laid down that the board was not to create a nuisance. It would consequently bo seen by this that the Education Board were not acting on a firm basis. So long as they kept from creating a nuisance they could make a diain through any pi oporty within the town. Ho had piep.uul a resolution on the matter which lie thought would meet the views of the board and would piopose "That the notices from the Education Boaid of Auckland appeal to have been issued on the supposition that the public drain cieated a nuisance, nth Mr Lusk's letter accompanying the notice^. That with a view of placing a correct statement before the Education Board, this board do visit and inspect the diain, and lmestigate the lepoited nuisance, the boaid to meet on the ground on Fiiday next, at 1 1.30 a.m. And further that the members of the school committee be iinited to accompany the boaid on their visit, and to make such repiesentation to the Education Boaid as in their opinion the case merits." —Carried. Johnson, " That to facilitate the acquisition by the (lo\ eminent ot the lands abutting on Whitaker Terrace and Queen -street for railway station pin poses, the boaid will (on the Government acquiring the liehts and interests ot Messrs Hally, McXeish and Passmorc to their seveial piopeities abbutting on the said streets) cede the rights and interests of the board in and to parts ot lots 418 and 419, to the Public Works Department, for the purposes above-named : Ami further, the board will offer no objection to the department acquiring the portion of Chapel-street lying to the North of ljuoen-street "West.— Carried. A communication from Mr Errington on the Water supply question was readund the meeting terminated.
