SEQUEL TO ACCIDENT
HEARD IN NAPIER DAMAGES ARE AWARDED Lawrence Norman Dyer, aged 12 years, through his guardian “ad litem”, Charles Dyer, in the Supreme Court at Napier yesterday afternoon, before His Honour the Chief Justice, Sir Michael Myers, claimed against Williams and Kettle, Ltd., for £l5OO general damages and £3Bl 8s 9d special damages arising out of a motor accident at Hastings on June 4, 1930, when the plaintiff received injuries to the leg through the alleged negligence of a servant of the defendant.
Before the hearing was completed counsel for both parties mutually agreed that the sum of £3BO was a fair amount to be paid by the defendant as special damages, whereupon His Honour directed the jury to award that sum.
In his summing up to the jury His Honour issued a warning against the awarding of punitive damages. The fixing of general damages was always a difficult one. “When I am assessing damages,” said His Honour, “I always try to avoid being niggardly. Then again I try to remember that I am not dealing with my own money, but with someone else’s.” , £9OO as general damages^*-I was awarded. , . '
