Mr Burnett appeared for plaintiff. Defendant did not appear. This was a pitiable case, the result of a hasty marriage, which took place in June last year. Both parties had large families by former marriages, and it was mainly owing to the children quarrelling that led to the separation of the husband and wife. Mrs Travers, during her evidence, stated that she had been asked to return to Mr Travers, but would not consider the matter unless certain things eventuated, one of which was a humble apology from a member of Mr Travers' family. The Magistrate said it was an unfortunate business altogether. He was very sorry the defendant was absent, for some satisfactory arrangement might have been made, However, he would make an order for ±1 a week from date, with costs and solicitor’s fee 21s.
Sowry v. McDiabmid. —Application for ejectment. Defendant was occupying a shop and dwelling in Vogel-street belonging to Mrs Sowry, and notice to quit had been served on him to leave the premises on the 20th April last, McDiarmid’s defence was that he was not a tenant of Mrs Sowry’s, but of the Peck Bros, to whom he paid his rent regularly. The Magistrate told defendant that he had no right to occupy the premises without the consent of the owner, and ordered him to vacate the premises on thaßth June, and to pay the arrears of rent, £2 10s, to Mrs Sowry.
