Mr W. Kerr, S.M., presided at the Magistrate’s Court this morning.. UNDEFENDED CIVIL CASES. Judgment by default was given in tbe following undefended civil cases;—J. A. Smyth v J. Chapman, £1 3s 6d; Halligan and Mopseman v Perrett Bros., £1 3s lid; Purser and Son v H. L. Hollis, £5; A. C. Lennard v. A. Blick, 11s 4d; A C. Lennard v Teone Paro, £1 19s; Gilberd and Sons v J. Toomcy and Co., £l3 19s; Gilberd and Sons v E. H. Gower, £1 Is; A. Hatrick and Co. v J. Donaldson. £ls; S. W. Wilson v E. O’Connor, 18s 9d. JUDGMENT SUMMONSES. Orders were made in the following judgment summonses:—F. Symes v A. W. Pinsent, £3 is, in default three days’ imprisonment, order suspended if defendant, pays 15s per month; L. W. C. Dampney v J. H. Blunden, £34 17s sd, in default 30 days’ imprisonment. SHELLEY v BARRETT. This case, adjourned 'from March 7th, was resumed in the S.M. Court this morning before Mr W. Kerr, S.M. Mr Hutton opened the case for the defence. It would be contended that there were no representations made, and that the statement put in" was given to Kraus, when Shelley was not present, and was made out on the spur of the moment, and was a mere rough approximation. Mr Barrett had only made a list of disbursements and receipts, and there was nothing to show that the difference between them was the profit. There might have been other disbursements and receipts not noted. It would be contended as the second point, that the obtaining of the landlord’s consent had been waived. Evidence would he given to show that Barrett was actually turning out 6000 loaves a week, and that he .was actually making more than £lO a week, and that there was no misrepresentation on this point. The case was continuing as wc went to press.
