Dismissed
(Per United Press Association^ AUCKLAND, April 9. Mr Kettle, S.M., gave his reserved decision this morning in the case against Richard Dyason, chief officer of the steamer Navua, -charged with having, on Sunday evening, March 29th, attempted a criminal assault <J? Florence Callaghan, aged 23. The Magistrate said the girl's story as to Dyason having dragged her to hi* cabin, struggling and resisting, was quii;e beyond credit, the night being calm/. and there being nothing to prevent cries o"f flis-tress-feeing heard by many people near- the vessel.- If her evidence so far was so-gross-\i /exaggerated, no jury of reasonable men " *w&iid£>e justified in accepting her statement «c to what took place in the mate's <!»bin. " She bore no eign of the struggle, -and absolutely refused to submit' to mcdi- ' cal examination. The case was dismissed.
