At the Benalla County Court sittings a local marine dealer, brought a suit against John Daws, the proprietor of an hotel on the Benalla to Mansfield road, to recover .£l9 for breaoh'i'of contract. Plaintiff and another, man "were travelling on the road in a lorry, and put up at Daw's for the night. They paid for their beds, but before showing them to their room M.rs Daws informed them they must wash themselves, as they were too dirty to sleep in her clean beds. Plaintiff and his companion refused to wash, and they were denied a bed, the money being handed back to them, but declined. The dust stained travellers had, therefore, to sleep outside. His Honor Judge' Chomley considered it was quite possible the plaintiff, after travelling on a hot and dusty road, would be in need of a wash. He thought the plaintiff had no cause of complaint, and the case was dismissed.
