Magistrate McCarthy gave judgment to-day in the case of George Harris, charged on the information of the Collector of Customs with using a net beyond the legal size for catching whitebait. Legal points had been raised by counsel for defendant, and the magistrate found that it was clear the Legislature contemplated there might be tidal waters or tidal rivers, parts of which were neither salt nor brackish, and to confine tho operation of the Act to the protection of fish found in gait or brackish waters was not only in accordance with the course of the legislation but also of the general tone of the Act. The mere fact that regulations were made to apply to fresh waters would not avail the informant, as in doing so his Excellency clearly exceeded his powers. The information was dismissed. Notice of appeal was given.
