AIKBN V. BAINBRIDOn. The plaintiff (William Aiken, of Fowler's, farmer) claims from the defendant (a farmer at the same place) specific performance of an agreement to transfer a piece of land containing 197 acres in the Apiti Survey District, and also damages for withholding the same. The defendant admitted the agreement, but denied that the conditions ,of it had been oomplied with, especially as to felling bush at the right season. Mr Barnicoat, instructed by Mr Walter Cathro, appeared for plaintiff, and MiMarshall, instructed by Mr W. A. Saudilands, for tho, defendant. * The case was completed at 1 o'clock, and on resuming at 2 His Honor made a deoree in favour of plaintiff,' with £25 costs and witnesses' expenses £10.
