MAN SHOT

ATTEMPT TO EVADE ARREST. COMMENT AT INQUEST. SYDNEY, Friday. A finding that Richard Augustus Thurling died from peritonitis following at bullet wound justifiably inflicted on him by Constable Kenneth Body while acting in the discharge of his duties, was returned by the coroner, following an enquiry into Thurling’s death.

Evidence was given that Thurling, who was aged 28 years, was fatally wounded by a bullet fired by Boyd to frighten Thurling, who was allegedly endeavouring to escape after the police had stopped a lorry on which were crates of fowls. The coroner said: “'lf an officer of the law endeavours to arrest a man who has committed a felony, and the felon is flying from justice and there is no other way to apprehend him, it justifies the use of extreme measures. The evidence is quote clear. Thurling was arrested for stealing a large quantity of fowls.”
