JUDGMENT FOR PLAINTIFFS. In the Featherston Magistrate’s Court yesterday, before Mr J. Miller, S.M., Peter McGee and Henry William Carrick, motor cyclists, of Wellington, claimed £65 14s and £32 Ids respectively from George Mclvor, draper, of Masterton. Defendant counter-claimed for £123 l'ls and £4B 11s. Observing that, in his opinion, defendant Jiad not .proved that he was on the correct side of the road, Mr Miller gave judgment in favour of the plaintiffs, as follows: —Garrick, £46 4s, solicitor’s fee £9 17s, and costs £2 8s; McGee, £27 10s, solicitor’s fee £6, and costs £2 Bs. Carrick, wlip was the first witness ! called, said that on the day of the accident, lie, with several other motorcyclists, left Wellington for Masterton. When coming down the hill (he was in the lead), he noticed a car driven by defendant, coming up. . The ear was then about 40 feet distant, and about four feet from the side of the cliff. The driver of the car appeared to lose his head and steered across the road, with the result that witness crashed into the car and received several injuries.

P. McGee gave similar evidence to that, of the former witness. In trying to avoid the accident., he said, he tried to pass between the car and the bank, but had been struck by the car, wfith the result that he was knocked unconscious.

F. Wilkinson said he was one of the cycling party, and that after the impact he took measurements with a rule, lent by a motorist, and had found the car well over on the wrong side of the road. There were no skid marks, and the driver of the car appeared to be in an excited condition.

George McTvor, defendant, said that, with his wife and family, he was travelling to Wellington, and when about one mile from the top of the Hill his wife told him to be careful, as there were several motor cyclists coming down the Hill. He changed into second gear, and was travelling at about five miles an hour. Suddenly he noticed a man on a motor cycle coming straight towards him. He remembered the crash, but was worried about his wife and children. He was sure that he was on his correct side.
