Charged x\ r ith being in a state of intoxication AA'hile in charge of a motor lonv, Arthur John Holman Avas convicted in the Police 'Court to-day, and placed on probation for 12 months. His driAcer’s license was cancelled also. (Senior-Sergeant McLean stated that shortly after 2.30 yesterday afternoon Holman was brought to the police station. He was put through various simple tests by witness as to sobriety, and could not carry them out. He said he had had three beers. Witness was satisfied that defendant had had too much liquor to be in charge of a motor veh- • i i lcle.

Constable Nairn said that at 2.30 he saw defendant driving a lorry in the Avenue. He noticed that the lorry was being driven in the centre of the street at a fairly fast speed. The lorry was stopped in Guyton street, and accused got out and was seen to stagger slightly. Witness, on speaking to defendant, noticed that lie had taken liquor. Defendant said that he did not think that he was under the influence of liquor. He had had four drinks only. He had had no breakfast and no dinner. The senior-sergeant suggested leniency in view of defendant’s circumstances. The magistrate said that in view of the circumstances defendant would be con\icted and placed on probation for 12 months, and his driver’s license would be cancelled.
