CLAIM FOR WAGES
WAIMATE DRAPERS DISPUTE £3O ALLOWED TO PLAINTIFF. Howard Carpenter Foster, draper of Waimate was proceeded against by George James Allan Shackleton draper of Waimate in the Timaru Supreme Court last week on a conn ter-claim to a claim which had been discontinued and was for the sum of £5O goodwill in respect to the terms of air-agreement between the two partices for the carrying on of a draper’s business in Waimate. Alternatively plaintiff counter-claimed for £42 being wages due for seven weeks at £6 a week. Defendant was represented by Mr W. I). Campbell and Mr A. C. Middleton (Waimate) appeared for plaintiff. The defence was a general denial of the counterclaim. ' Mr Middleton said that the plaintiff and the defendant entered into an agreement for the sale and purchase of a draper’s business in Wai mate. Under the agreement Shackleton remained in the business as manager for seven weeks, Foster being unable to reach Waimate. It suggested t’i:a f although Shackleton remained in the business he
did not ... i as manager. Correspondence relative to the agreement would show that instructions to the staff were issued bv Shackleton. This suggested that he was managin’. After hearing evidence, his Hon our gave .judgment for plaintiff for £3O, with eosls on the lowest scale.
