SUMMONS SERVED ON M.P. INVALID AS HOUSE WAS SITTING
WELLINGTON. Last Night (PA) A member of Parliament cannot be summoned while Parliament is sitsting, said Mr N. T. Gillespie, Lower Hutt City Council solicitor, in the Magistrates Court, Lower Hutt, today. Ho was asking for the withdrawal of a charge of speeding laid aganst Mr Bert ip V. Cooksley, M.P. | for Wairarapa. Th<* charge was that iMr Cooksley cxceeaed 30 miles an hour in High Street, Taita, on October 18. Mr Gillespie said that though a summons had been served on Mr Cooksley, it was invalid because Parliament was sitting. The Legislature Act. 1908, ruled that a member of Parliament could not be served with a summons while Parliament was sitting, or ton days before or ten days after. Mr J. Bessel I, S.M., agreed to the withdrawal of tho charge.
