The Soviet member of the Tribunal, Major-General Nikitchenko, put on record his dissent from the acquittals of von Papen, Schacht and Fritsche; he also dissented from the sentence on Hess, who he believed shouiu have been sentenced to death. Ke also believed that the Reich Cabinet, General Staff and High Command should have been declared illegal organisations.

The chief American prosecutor, Justice Jackson, later issued a statement saying that he regretted that the Tribunal had acquitted Schacht and von Papen, and had also failed to declare the High Command criminal
