The case arose from an accident at Nukumaru on January 30 last. Alexander Johnston, farmer, of Marton, said that he was driving toward Wanganui from the direction of Waverley, when McGregor's car approached from the rear. At the same time another car was approaching from the opposite direction. McGregor’s car cut-in in front of him. causing his (Johnston's) car to run into a ditch. McGregor's car hit a telegraph pole. Police evidence showed I hat Ihe two front mudguards, the right hub and the windscreen of Johnston's car were damaged. There were signs that McGregor's car had struck the other in passing. McGregor said that there was ample timeDfo pass Johnston's car. because the approaching car was four or five chains away. He claimed that his car skidded in loose metal, but denied any knowledge of its having struck Johnston's car in passing. The magistrate said that the police evidence showed that Johnstcn’s car had been hit.
