DAMAGES AWARDED SUM OF £BB2 12s t Per Preet Aesocietion.l WELLINGTON, March 3. Finding that the defendant's negligence was the real cause of an accident, a jury of 12 in the Supreme Court to-day awarded John Robert Herock, waterside worker, £BB2 12s damages against Lewsley Suridge Mercer, a Wellington driver of a motor-car which knocked him down in Featherston Street on the evening of June 12, 1938. juries and as on the previous day when the hearing commenced, he was carried into Court on a stretcher, being still an in-patient of the Wellington Public Hospital. Alleging negligence against the defendant, he claimed £2OOO general damages and £lO7 12s hospital expenses to date and a sum to recompense him for the loss of wages, which he stated used to be an average of £3 a week. In answer to the issues put to them the jury stated that both plaintiff and defendant were negligent but that the defendant’s negligence was the real cause of the collision. They awarded hospital expenses in full, £25 for loss of wages and £750 general damages.
