RESTITUTION APPLICATION JUDGE ADJOURNS HEARING [ Per Pre.«s Association. I AUCKLAND, June 7. During the hearing of an application by Charles Edwin Hills against his wife for restitution of conjugal rights, petitioner in evidence said that he was living in an apartment but would soon make a home for his wife if she returned. The parties formerly lived on a farm at Mercer. Mr. Justice Callan said that the difficulty was that petitioner did not have a home to receive his wife. In England the practice was not to allow a petition for restitution to be proceeded with unless the petitioner had a home ready to receive the respondent. His Honour asked counsel, Mr. lan Simon, to present a memorandum setting forth his argument in favour of the granting of the order askrl for. The hearing was meanwhile adjourned.
