GARDEN ASSAULTS

DISMISSAL OF APPEALS. Received June 15, 11.15 p.m. SYDNEY, June 15. The first of the appeals by the eight men convicted of assaulting Mr. J. S. Garden on May 6, was heard before Judge Curlewis to-day. Counsel sought to show that there was a conspiracy on the part of certain people to cause an assault on Mr. Garden for political motives involving the New Guard. The judge dismissed the appeal saying: “I am sony that I cannot increase the sentence of three months already imposed. ” Mr. Teece caused a sensation by remarking: “I am retiring from the case. I cannot see any use in remaining as junior counsel.” Three other appeals were later dismissed and th® remaining four were adjourned till to-morrow.
