THE AIT. COOK COMPANY HEARING OF CLAIM CONCLUDED L Per Press Association. ] CHRISTCHURCH, Oct. 13. The action brought by A. J. White, Ltd. against the Alt. Cook Tourist Company for £10,865, alleged to be due for furniture supplied for the Chateau Tongariro, was concluded in the Supreme Court to-day before Air Justice Kennedy. Decision was reserved. Mr A. W. Brown, counsel for plaintiff, submitted that the defendant company was on the horns of a dilemma, in that cither the Alt. Cook Company and tho Tongariro Company were separate companies only in name, or that it had by action, word and letter deliberately set out to deceive and actually deceive the plaintiff company into thinking that there was a partnership between the two concerns. In cither case plaintiff was entitled to succeed. The Tongariro enterprise was a Mt. Cook Company concern, and this suggestion had been conveyed by Wigley in order to get credit for the Chateau Tongariro furniture. He contended that White’s had been defrauded by the Alt. Cook Company and were intended to be so treated from the inception of tho transaction. Wigley had given the impression that the two companies were associated, but had endeavoured to leave a loophole by which payment could be evaded if the necessity arose.
