INTERESTING LEGAL POINT [ Per Press Association. ] DUNEDIN, Aug. 11. An interesting point concerning third party risk for motorists came before Mr Justice Kennedy this morning in the case of Gordon Perry v. the London and Lancashire Insurance Co., plaintiff asking for an order to determine whether upon agreed facts defendant was bound to indemnify the plaintiff against the payment of an amount for which judgment might be entered in the Magistrate’s Court. The point was the extent of indemnity in the policy words “liability ar, law for damage to property.” Plaintiff , claimed that the clause was so wide as to indicate complete indemnity, whereas defendant held that the policy had effect only as regards actual damage to the third party and not any consequential damage. Decision was reserved.
