SANDON THE PLUNKET SOCIETY Th e annual meeting of the Bandon Plunkct. Society was held at the County Office, Sanson, on Friday evening. There wa s a guod attendance of •members, the chairman of the Advisory Committee was voted to the .hair. Th e annual report presented by the president (Air J. II • Perrett) showed tho branch to bo in a sound financial position. A concert held during the year had realised a profit of £2O 15s and the garden party held at Mr J. F. AlcKelvie’s grounds resulted in a net profit of £B4 8s 9d. The balance in hand at the end of the year is £10!) Us Gd. The hearty thanks or the committee is due to Mr and Airs AlcKelvie for their assistance on the occasion of the garden party and also to all those who presented trophies for the competitions, Mrs Nelson Harris, Aliss P. Cornfoot. and Air Geoffrey Whisker being specially named. Thanks are also due to the trustees of the .Methodist Church for the free use of room for the nurse when visiting the* i district, and to Airs Adams who has so capably carried out the duties of lion secretary and treasurer. Te Kawau Rugby Sub-Union The annual meeting of the above ftub-union was held at Rongutea on Thursday evening. The president (Air JL J- lagan) was in th G chair, all clubs being well represented. The report and balance sheet showed the affairs of the sub-union to be in a very satisfactory condition. The total receipts for the year were £B2 IGs Id and expenditure £G4 7s, leaving a credit balance of £lB 9s Id. The re port stated that a most successful season's play had resulted and the efforts of the sub-union in giving every encouragement to school football has improved the standard of the third grade play. The senior representatives had a successful season, winning all of their games and in the game 'against Alanawatu B played at Sanson, won the Wallace Cup. The junior representatives defeated Oroua and against Alanawatu thirds played a draw in one game and i won the return game. Illston scoring all the points. RAETIHI MAGISTRATE’S COURT Last Saturday Sidney Joseph Samways, aged 27 years, was brought before Alessrs. T. Fagg and R. Sigley, J.P. and charged with escaping from Waikane prison on Thursday last. In the early part of the morning the prisoner cut through the wall of his cell and was making away along the railway line, when he was captured some hours later by Warder Quid, who was on the look out for another escaped prisoner named Walter I’atrick Alurphy, who escaped from the Horopito prison camp on Tuesday last ami is still at large- Sainways pleaded iguilty and was sentenced to 12 months’ I hard labour in addition to th e sentence he is already serving. The nurse’s report showed that the general health of babies had been satisfactory. There wer e 131 old cases in the district, 2 new cases, 51 visits to office by adults. 41 visits by babies and 23 visits by older children.

Motor AccidentsThere has been an epidemic of motor accidents in the district the last few weeks and the Council has decided to erect danger signs at the worst cross road corners. The above precaution voukl have been of no us e in preventing a collision in th e township about 7.3 U on Saturday evening. A light lorry on route from Wellington to Wanganui was parked on the main road well off the bitumen and was hit by a service car from Wanganui. The services of a repair car wcr 0 necessary to allow the journey to be continued. The mishap was promptly reported to the police both at Rongotca and Palmerston North. On judgment summonses.— Johnnie Cole was ordered to pay A. Guinan the sum of £l9 Is, in default 21 days’ imprisonment (costs £1 Is); Garnett. Westwood (Foxton) vas ordered to pay Ford and Co. as assignees of E. C. Gaisford, the sum of £26 4s, in default 21 days imprisonment (costs £1 Ils dd). The Alanawatu County Council (Inspector AV. Berry) proceeded against a number of cyclists for riding cycles on footpaths; riding without lights, and for not having reflectors. Fines of 10s (costs 10s) wore inflicted. . Ratepayers Satisfied.

Ratepayers’ rolls were presented by | the Bulls Town Board (Air F. C..tts) and the Rangitoto Rabbit Board (Air R. lAfackay appearing for the secretary, ,Mr H. A. Goodall), and there being no objections, the lists were passed.

AVandering Stock. Tho Alanawatu County >uncil (Inspector AV. Berry) proceeded against W. Fay for allowing eight cows to be at large on the Sanson-Awahuri highway, the day being a race day, when traffic was great. A fine of 25s was inflicted (costs 12s). Breach of Award. Joseph Lowden, Inspector of Awards, proceeded against D. Al. O’Connell, butcher, BuJJs, claiming £lO penalty for employing a person between September and December, "928, at a wage of £3 ss, the award rate being £4 16s. Air R. Alackay appeared for defendant. The inspector gave evidence in support of the claim. To Air Alackay: It docs not matter if thf, summons states that the person is a butcher, whereas he U only message boy. The award says that he is n butcher.

Air Alackay commented: Therefore defendant is bound to pay this boy the high wages of an experienced butcher? While if he is doing heavy work on a farm he would be lucky to get 30s a week? The boy, who is in Court, looks to be a mere youth, though it now transpires that he is just over 21 years of age. Defendant understood that the boy was under age, being misled by his youthful appearance. The boy had no previous experience, and defendant was new in business, and had no experience of such employees. Counsel quoted a somewhat similar case which came before the Arbitration Court in Welling-ton,-and the Judge had merely entered a conviction, but did not consider it necessary to inflict a penalty. The S.AI. in delivering judgment, said that the employer should have known the terms of the award, and he should have been more careful. There was no doubt in his Worship’s mind that tho thief factor in this case is carelessness. He took the boy into his employ without making full inquiry one way or the other, but it was not a bad rase. Defendant no doubt thought that in employing an inexperienced boy the award did not apply. It was not a case for a largo penalty, which would he fixed at £2. No costs would be allowed but the Inspector’s expenses, 10s. Sharemilkers at Variance. Another of the many sharemilking disputes occupied the time of the Court. In this case J. W. Lind, sharemilker, I’arewanui, claimed £ll. from 4. Afarumaru, settler, Parewanui, being the’ balance of the January cheque due to him under the sharemilking agreement. The claim was admitted, and judgment was accordingly entered for the amount, with costs £1 It’s, and sojlicitor’s fee £2 12s. Defendant coun-ter-claimed for £39 7s 7d, being made (up of cost of ' ayinaking, which should ihave been carried out by plaintiff, £l5 7s 7d, and the value of two cows lost through plaintiff’s alleged negligence, £24. Mr J. Ongley appeared for Lind, and Air R. Alackay for Afarumaru. J. Alrrumaru gave details of the haymaking transaction, and stated that Lind failed to carry out his instructions as to keeping the fences in order. In consequence the herd of cows got into a paddock of clover for a period of two hours. A period of 20 minutes in clover was dangerous to any cow. Of the 95 cows, + wo died; becoming bloated, nnd having to be pierced. Part of the original agreement was that Lind had to do the haymaking, but as Lind was unfinancial the first season, witness had done it, and Lind had made no demur at the charge. AVitnoss did the haymaking again this eason, and was charging Lind for it. J. Castle gave corroborative evidence regarding he cows. Lind’s version was to the effect that the arrangement was that Afarumaru would do the haymaking, and would pay him (Lind) Is 9d an hour for the time he worked. He denied Alarumaru’s statements regarding the arrangements. As to the cows getting into the clover paddock, this was due to the state of the fences, which were very old and poor, and not capable of keeping them out. When he found that they were in tho clover he removed them immediately. Two had died, and ho did not dispute their value. Two neighbouring farmers said that they would have helped Lind with the haymaking without charge, as Lind had helpeu them. Air AA’atson, S.AI., in summing up, said: The Court here has to deal with a claim in which there !s no definite written agreement. It is therefore for the Court to do the fair thing on the evidence produced. As far as the claim for the loss of the cows is concerned, after hearing the evidence, he was of the opinion that the “blowing” of cows was a risk which dairy farmers had to put up with, and Alarumaru has fairly admitted this. In the absence of any satisfactory evidence’ to the contrary, he regarded the loss of the cows as an ordinary risk. Further, Lind himself also lost a cow. There is no doubt that the fences were not satisfactory, and it seemed that they had received no attention. He therefore dismissed that part of the claim. There was not the slightest doubt that the haymaking arrangement was of some use to the plaintiff. It saved him a certain amount of expense in employing assistance, as per the agreement, and then there was his own time to be taken into consideration. Alarumaru had had to pay out £l4 10s Id for labour, and in view of the arrangement made the previous season this item would be allowed. Judgment was* er-; tered for Afarumaru on the counterclaim for this amount, together with costs £1 3s and solicitor’s fee £2 2s. Land Agents’ Licenses.
