DUTCHMANS APPLICATION ADMISSION TO SUPREME COURT REFUSED [ Special “ Chronicle ’’ Service J WELLINGTON, March 30. In the application by Hey ting for admission to the Supreme Court, two questions were raised: (a) Whether ileyting, being a Dutch subject, could be admitted* as a solicitor to the Supreme Court without first being naturalised as a British subject; (b) whether an applicatant for admission could file notice of his intention to apply for admission before he had sat for the requisite examinations. On both questions the Court of Appeal decided against the applicant. No costs, however were allowed against him. In Wackrow v. the Takapuna Racing Club the Court of Appeal found in favour of respondents, hokling that on the day in question the race track was as sate as all reasonable skill and care could possibly make it, and that the danger itself was such that appellant should have been aware of it. Further the respondent club had taken all reasonable steps to make the owners of horses cognisant to the state of the course and owners had accepted the position. if appeal was therefore dismissed. In Kerr v. the Avon Dairy Co., the Appeal Court held that the pojition was that whether the case be regarded as involving a contract to pay as good a price as was payable for butter-fat by co-operative factories in the district, or a contract for the sale of goods at. a reasonable price, appellant will be entitled to recover the sum of 3d per lb. for butter-fat supplied during the season in addition to advance payments made to him. The appeal was allowed with costs on the lowest scale as from a distance.
