SALE OF HOTEL
THE NUMBER OF FLOORS INTERESTING WELLINGTON LAWSUIT. [Per Press Association.] WELLINGTON, June 13. Judgment in the case in which the number of storeys in the Trocadero Hotel was in dispute was given to-day by Mr Justice Alpers. In reviewing the evidence, his Honour mentioned that the case was an extraordinary one, defendant having gone in for a contract involving £40,000 without inspecting the building, even though be had resided at an hotel next door for four or five days before. His Honour thought the building was one of five storeys, but thought the statement should be qualified in some such way as to make it clear that the covered-in portion on top was not so great in area as that o£ the other storeys. He thought the item on the agent’s memorandum an innocent misrepresentation, and that if defendant did not succeed on those grounds, he would on grounds of a common mistake. It was quite true that the purchaser had largely himself to thank for the present litigation. He thought plaintiffs must fail in their prayer for a decree for specific performance. Costs were allowed on the highest scale, with two extra days at 15 guineas.
