MAGISTRATE’S COURT. Before Mr R. M. Watson, S.M., on Friday, Stewart Arnold Signal was fined 40s and costs 7s for failing to attend camp at Trentham last year. The information was laid by the Defence Department. Rangitikei County Council’s traffic inspector proceeded against Wilfred Hickson, who was charged with driving a motor car without a license on May 21, also with not being the holder of a license. This was the Council’s first prosecution under the Motor Vehicles Act. On the first charge, defendant was fined £1 and costs 7s and on the second charge he was convicted. The Magistrate said the Act provides that a penalty of £lO may be inflicted and a second offence by accused would be dealt with severely.

For riding a motor cycle and side car on June without a light, Robert Allison was fined 15s and costs 7s.

For breaches of the by-laws (riding without lights) the following were each fined 10s and costs 7s: —Trevor Tolley, Henry Czepanski, Frank Nuttall, Theodore Schultz, William G. Tolley and W. J. Nuttall, For a similar offence Joseph Wasson was fined 10s and costs 12s, and John Milne 5s and costs 10s. The Magistrate stated that these light fines were imposed as a warning and heavier penalties would be inflicted on future offenders.

MAINTENANCE CASE. Tn the applications for maintenance, Ellen Wilkins v. Percy James Wilkins, his Worship made an order for maintenance, based on defendant’s offer to plaintiff to continue residing in his (defendant’s) house, making over the furniture to plaintiff. By consent, an order was made for guardianship of the throe children by the plaintiff, maintenance of 25s per week for plaintiff and 10s per week for each child. Costs amounting to £2 2s were awarded plaintiff. GENERAL. Judgment for plaintiff by default was given in the following: H. E. Warren v. P. Beard £64, costs £5 2s; H. Ward v. G. Hartley £6 Is 7d, costs £2 8s 6d; Christensen and Stanford v. G. Hartley £4 Ils 6d, costs £2 1 s 6d; E. B. Cobham v. C. R. Birchall £l7 10s, costs £2 14s. CLAIM FOR TENANCY. In the adjourned case E. Humphrey v. A. E. Palmer, an application for tenancy of a house owned by plaintiff, Mr Stanford emphasised the hardship which would be imposed on defendant if he wore turned out. Defendant had made every effort to secure a dwelling. The case was further adjourned for one month. CLAIM FOR DAMAGES. A sequel to a collision which took place at the intersection of Mill Street and Pukepapa Road, Marton, some weeks ago, was heard in Marton Magistrate’s Court on Friday before Mr R. M. Watson, S.M., when Joseph Walker claimed £36 14s Id and James Fergusson £lOO 9s from Walter Oldfield, being damages sustained in a collision between defendant’s motor car and a motor cycle and side car in which plaintiffs were riding. Mr J. R. L. Stanford (Messrs Christensen and Stanford) appeared for defendant, and Mr L. Cohen, of Wanganui, conducted plaintiffs ’ case. Dr Dick, of Marton, disclosed that Walker visited him on the morning of the collision and was attended by him from April 21 till May 12, Walker being incapacitated for about a month. The plaintiff, Walker deposed that he was in the side car at the time of the collision. After going over the crossing, Fergusson slowed down to about 10 miles an hour. He (Walker) did not see anything coming along Mill Street and did not know whether there was a car in Mill Street. It was not until they were within 30 feet of Mill Street that they saw the car. The car, he said, rounded the turn on its right hand side, facing him. When the impact occurred the car was in Pukepapa Road. The motor cyclist could not havb done anything to avoid the accident, but he said, the driver of the car could have done so had he kept to his proper side of the road in taking the

turn. After the smash, he said, Oldfield stated that ho was not expecting a car to come round the corner but was avoiding a cyclist. Defendant had intimated that he would come to some agreement -with plaintiffs but had. failed to do so. In reply to Mr Stanford, Walker stated that the motor cycle and side car was proceeding at a fairly slow pace after going over the railway crossing. He did not see the cyclist before the accident. The case was adjourned for inspection ’of the locale of the accident by the magistrate. MARTON DISTRICT A. AND P. ASSOCIATION ANNUAL BALL. The increasing popularity of the annual ball of the above association is evidenced by the large sale of tickets for this popular fixture in the Marton Town Hall on Friday, July 3, and indications point to the attendance being a record one. The ladies’ committee have received excellent support and as the supper and decorations arc being carried out by this committee under the supervision of Mrs H. S. C. Morrison, patrons may expect to witness an artistically decorated dancing room, whilst the supper is their masterpiece. The Marton Premier Orchestra, which has icceived a first class selection of dance mu’Sic, are determined that their branch of the entertainment will not no lacking. The price is a very popular one (12s 6d for a double ticket) and those may be obtained from any member of the committee or Mr A. Way, secretary, Marton. RANGITIKEI HUNT.
