EXTRADITED.

(Per Press Association.) AUCKLAND, Sept. 12. Whether Thomas Aubrey Jones should be detained in New Zealand to support his wife or should be sent to Sydney in regard to a chargo of theft, as the question which has been ocupying the attention of the Magisterial authorities in Auckland for some time past. Jones has been charged that at Tarn worth (New South Wales) he stole in November last £100. To-day a police officer from that State appeared, and Chief Detective McMahon asked that Jones should be extradited to Sydney. Mr A. E. Skelton appearing for the accused ,opposecl the request on the ground that Jones was now held by the New Zealand Court. He had been ordered to find security for compliance with a maintenance order for the support of his Avife, and was only allowed liberty so long as he reported himself daily to the police. Failure to do this would mean three months' imprisonment. Counsel added that his client would be able to clear himself of tho charge of theft, as it was only a matter of partnership accounts. Mr R. A. Singer. who appeared for the accused's wife, further complicated matters by onpositie the Qxtrad/ition proceedings. He w.ished to have the maintenance order increased.

After considerable argument Mr F. V. Fraser, S.M., said that the accused not having been convicted of any offence was extraditable from New' Zealand. The maintenance order could be enforced in Australia the New South Wales escort having promised to advise the department to keep an eye on the accused at the termination of the proceedings in connection with the theft charge. The extradition order was made.
