Walden, for having assaulted Sydney Nimmo Muir, at the Hutt, on the 19th of August, wag resumed at the Resident Magistrate’s Court, Wellington, on Wednesday, before Mr Wardell, R. M. Mr Wardell said the evidence for the proeecutioH bad been such that he should feel it his duty to send the case for trial. Was it the intention of the defence to call evidence ? Mr Stafford : No, your Worship. Mr Warded: Then I shall have to deal with the case aa it is.

The neual caution having been read out, the accused said : I wish to reserve my defence, your Worship. Mr Wardell sold he felt hound to send the case for trial. After bestowing so much time open the case, he felt bound to state his reaeona for doing so. He had allowed no extraneous matters to influence him in any way, and he had altogether put from his mind what had been described aa outside feeling. There might have been a strong feeling outside in reference to the case, but except a little acrimonious feeling on the pat; of counsel, the evidence had not shown it. The evidence was a gathering together of email matters. Separately they were of little weight, but taken collectively, they were of such a character that he felt bound to send the case to a jury.

The prisoner was committed to take his trial at the next Supreme Court sittings. All the witnesses were then bound over to appear at the Supreme Court. Bail was allowed — the prisoner in his own of £2OO, and two sureties of £IOO each.
