A MOTORING COLLISION
TE AWAMUTU DRIVER FINED. “I cannot accept defendant’s version. It would have been impossible for an accident to have happened according to his evidence,” stated Mr F. H. Levien, S.M., in the Otahuhu Police Coui’t yesterday, when convicting . a Te Awamuau motorist, Arthur Charles Fowler, of failing to give way to traffic on bis right. William Henry Neale said he was driving out of East Tamaki Road on to the Great South Road at Papatoetoe on May 5 when defendant’s car collided with his. Witness had stopi ped to allow two cars to pass and then, observing no other traffic, proceeded into the main road. When on the centre line his car was struck on the left-hand side. Cross-examined by Mr Holmden witness said he had no sight in his left eye. Defendant, in evidence, said he saw Neale’s car stationary in East Tamaki Road and took that as an invitation to go through. He had been following another car at the time. When almost opposite the intersection Neale’s car came on and struck defendant’s car on the r-ear righthand mudguard. He had applied h's brakes immediately Neale came on. The magistrate said he must accept Neale’s evidence. Defendant would be convicted and fined £2 and 26s 6>d costs.
