OTOROHANGA SITTING. (Before Mr Orr Walker, S.M.) ' The monthly Otoirohanga sitting of the Magistrate’s Court was held yesterday before |Mr Orr-Walker S.M. ALLEGED FORGERY. John Tipani was charged with the forgery of an endorsement on a cheque (for £4) at Hamlil'ton last May. He was nelmanded to appeair at Hamilton on November 3rd bail being allowed in the surety of £IOO by himself and a second of £IOO. c His Worship read his judgment in the case of W. H. McKenzie v. Otorohanga County -Council a claim for value of sheep (£3B 7s 8d) which it was alleged had been poisoned by eating tutu left on ’the road by the Council’s staff. The judgment was as follows: After consideration of the evidence I cannot .say I am satisfied that Ithlsi plaintiff has proved that his sheep died as the direct result of eating the tutu on the road. Indeed: I think the evidence rath|e(r proves (that they died from other causes. Furthermore, I think the plaintiff failed in his duty to take reasonable care of his own property when he (drove' the sheep over the road when he knew there were tutu cuttings along the road. I am not satisfied that there was such a large quantity of tutu clippings on the road a s alleged by the plaintiff. - Judgment would be 1 for the defendant with costs £6 ss. ~ Mr H. Corbett appeared for the plaintiff and JMr F. Phillips for the Otorchanga County Council. Judgement by default was given in favour of the plaintiff’s in the following cases:— Otorohanga Town Board v. Te Aue Kaahu, cLalim £7/10/7; 'C. G. Hodgson v. D. Farmer, claim £4/11/6; A . B. Allen v. S. Bevan, £6; J. Belcher and Co., v. S. Bevan £2/8/9; John Trapski v. P. Adams, £l9fil/4. JUDGMENT SUMMONSES Farmers’ Co-operative Auctioneering Co., (Mr Mossman) v. Kino claim £26 16s; ordered to pay by instalments of £2 a month the first payment to be madia ion 27jtih November. . H. H. Vernon v. Graham Searancke claim £24 13 fi; ordered to pay £24 13s 6d and, cost £1 11 6d by instalmentsl of £5 per month as from 30 November. In default 14 days in Auckland., prison. Williams, and Bruce v. Henry Walker claim £29 9s 2d; ordered to pay £1 per month and costs. Frank M. Winstone Ltd. v. D. Monrad claim £lO 4s 9d; oidered to pay the sum claimed! by instalments of £2 peir month commencing 27th November.
