Further evidence was given as to the presence of the man Marshall on the engine of the wrecked train. One witness said that at Waipukurau he saw two strangers on the engine and it was stated that the driver would be responsible for allowing a third person aboard without a permit and that the fireman would be liable to a fins if he did not report it. A railwayman who was a passenger on the train said he helped to get a man out of the rear of the engine after the smash. He was Marshall and he was in a state of collapse. Marshall was not called as a witness and at the conclusion of the case the driver, Lavin, was committed for trial.
