DEATH OF A DOG

RUN OYER. BY CAR CLAIM AGAINST MCfrORIST The death of a valuable cattle-do was the subject of a claim for £1 brought at the Magistrate's Court Hamilton, yesterday before Messrs R F. Haycock and J. H. Gittos, J's. P.. b: Gilbert Baird, farmer, of Te Rapa against Walter H. Fricker, signwriter of Frankton Junction. Mr L. Tompkins appeared for plaintiff, Mr W. J King representing defendant. The allegations of plaintiff wer? that Fricker drove a car negligently and at an excessive speed in Norton Road, giving the dog no chance whatever to get clear. The animal was run over and killed instantly. The defence was that the car was travelling at a reasonable speed and that Fricker had no opportunity of avoiding the dog, which suddenly ran out in front of the car. The Bench was not satisfied that any negligence had been proved against defendant or that he was travelling at a dangerous speed, and accordingly non-suited plaintiff.
