TROUBLE OVER FREIGHT.

AUCKLAND, Friday.

Claim and counter claim were involved in an action between Edmund George Broad, of Waitomo Caves, and J. Brittain, Ponsonhy. Plaintiff claimed that defendant had sent a sheepdog in July last to the caves, for which the sum of £7 10/ was forwarded on account of the purchasing price, Plaintiff was dissatisfied with the dog’s capabilities, but Brittain refused to accept it back, and also declined to refund the £7 10/. Brittain claimed that two dogs were sent on the condi-

tion that they were to be' returned within one month, freight was to be paid by Broad. The latter it was claimed, did not return the dogs in the specified time, nor did he pay the freight, wherefore Brittain claimed £l7 10/, the balance of the purchasing price. Mr Boynton said he must give judgment for Broad. The dog had been given a fair trial, and proved unsatisfactory. The trouble over the freight could have been settled ‘ by paying under protest.
