N A BIT OF A PROBLEM CONDITIONAL BUILDING PEBMIT The Borough Council again had the "bit of a problem" before it at its monthly meeting on Wednesday last when W. Leighton applied for a permit to erect a dairy on his section in Princes Street. On the same subject the Chief Zoning Officer of the Transport Department., Wellington, had written as follow: "I have received an objection from Mr J. A. Campbell, a Cambridge milk vendor, against Mr Leighton opening a dairy shop or depot in Zone 2, which is gazetted to Mr Campbell. The Regulation specifically excludes dairy shops and depots, but where neces- ( sary any zoning scheme may be altered to protect a vendor's quota. In this case, if Mr Leighton opens a dairy shop in zone 2-he will gain sale at Mr Campbell's expense. I will be pleased if, when Mr Leighton opens his shop, the Zoning Com- I mittee will advise me whether it considers an adjustment necessary and, if so, what adjustment it recommends." Cr. S. Lewis said that the Works Committee had decided to refer the matter back to the full Council. It was one presenting considerable difficulties. Firstly, there was some objection from the applicant's competitors and on the zoning question; and, secondly, the question of the requirements of the Town Planning Act. There was the question of whether or not the Council had the right to.give a permit to erect a dwelling later. A plan was on the Council table showing that the proposed depot would be erected well back on the section. Cr. T. Cummings: The trouble is if Leighton sells milk from the dairy when it is erected and in another man's zone. It would be overcome if Leighton would enter into an agreement not to sell milk from his depot. Cr. H. Aymes: I think it is futile for the Council to discuss that aspect. That matter is for the Zoning Committee and the Zoning Officer to decide. At this stage Cr. Aymes moved and the Mayor seconded that the .application for a building permit be granted. The Mayor agreed that all the Council was concerned about at present was the plans for and the granting of a permit for the dairy. Cr. Lewis said it was disappointing that Mr Leighton had not put in an application for a permit to erect a residence as well. "How is he going to conduct a depot under such conditions In my opinion it would conflict with the Town Planning Act if a dairy only was erect- i ed." The Clerk said he was aware that plans for a residence were in course of preparation. Cr. W. R. Garrard repeated that he could give an assurance that the residence would be erected. As an amendment Cr. M. Wells moved and it was seconded that the permit be granted conditional that an application for a. permit to erect a dwelling will be forthcoming. On being put the amendment was carried.
