MOTOR SERVICE. PERFORMANCE OF AGREEMENT? CASE AT HAMILTON. - (By Telegraph—Press Association), HAMILTON, This Day. An action seeking specific performance of an agreement for the sale of a motor service run, including a mail contract and the cartage of .school children between Hamilton and Tauranga, was brought in the Supreme Court, Hamilton, on Thursday by George Freeman Willcocks, service car proprietor,. Cambridge, against W. ITrcn, motor. driver, of Hamilton. There was an Alternative claim for £SO damages. After legal argument had been advanced, Mr Justice Smith, who presided, held that the contract itself was not attacked. No false representations had been established and it was a qttea~ tion of damages. Judgment was given for plaintiff for £5, with solicitors' fee, witnesses' expenses and disbursements. EXCESSIVE SPEEDING. CAMBRIDGE-HAMILTON ROAD. LORRY DRIVERS FINED. HAMILTON, This Day. Fines of £5 each were imposed on Joseph Benton and George McDonald in the Hamilton Magistrate's Court yesterday for driving laden motor lorries on the Hamilton-Cambridge Road at speeds in excess of .those provided by the motor regulations. Evidence was given by Mr A. I. Maguire, traffic inspector, that Benton travelled miles an hour, when the maximum s'pecd allowed for his class of truck was 25 miles, and that McDonald travelled-at 30 miles an hour, instead of 21 miles an hour or less. The Magistrate, Mr Wyvern Wilson, remarked that local bodies must be protected, and that speeding did more damage to the road than heavy loads. THE PRIME MINISTER. ( ' MUCH BENEFITED IN HEALTH.
