TRIPLE COLLISION.

Two Motor-cars and Bus Involved. CIVIL CLAIM RESULTS. A civil claim for £156 14s sd, arising from an accident involving a motorbus and two motor-cars came before Mr 11. A. Young, S.M., this morning. The plaintiff was A. J. Archibald, garage proprietor, and the defendants were A. E. Grubb, bus driver, and J. Slack, pastrycook. Mr A. 11. Cavell appeared for Archibald, Mr W. J. Sim for Grubb and Mr W. F. Tracy for Slack. In the statement of claim, the plaintiff set out that on January 31, 1933, he parked his car in Oxford Terrace, close in against the kerb. At about 4 o’clock that afternoon Grubb so negligently drove a motor-bus in an easterly direction along Oxford Terrace that, after colliding with a car negligently driven by Slack, the bus collided also with plaintiff’s car. As a result plaintiff’s car was badly damaged. The damages sustained by plaintiff were caused by the negligence of Grubb and/or' Slack. Grubb’s negligence consisted in failing to keep a proper look-out, travelling at an excessive speed, failing to give adequate warning of his approach and of his intention to pass Slack’s car, overtaking and attempting to pass the car when the road was not clear, and failing to stop his bus when a collision was imminent. Slack’s negligence consisted of failing to keep a proper look-out and failing to signal his intention to turn. The sum of £Bl 14s 5d was claimed as special damages and £75 as genial Had to Swing to Right.

Mr Sim said that Grubb was placed in a position of severe emergency by Slack’s action and afterwards was congratulated by passengers in the bus on his skilful handling. When the bus was close up behind Slack’s car, Slack swung round in front without giving warning and after he had given every appearance of going straight on. Slack gave no indication of his intention to turn. All Grubb could do was swing to the right. (Proceeding.)
