DEATH DUTIES.
Question Asked in Supreme Court. An originating summons t.o determine the incidence of certain death duties payable in respect of a postnuptial settlement made in 1884, in the estate of the late Lewis Mathias, came before Mr Justice Johnston in the Supreme Court this morning. The Court was asked whether the duties assessed in respect of the property assessed in the settlement were payable by the executors under the will out of the testamentary estate of the testator, oj whether they were payable out of the funds included in the settlement. Mr F. J. Rolleston (Timaru) appeared for the trustees under the will, and Mr Loughnan represented the trustees of the settlement. After hearing legal argument, his Honor reserved judgment.
