Motorist “ Just Over Borderline.” (Special to the “Star.”) AUCKLAND, April 10. Charged with being in a state of intoxication while in charge of a motor car in Symonds Street yesterday, Thomas Arthur Kemp, aged 59, for whom Mr. T. R. Holmden appeared, pleaded guilty in the Pollen Court, before Mr Wyvern Wilson, S.M. Senior Sergeant Flanagan said that at 4.15 yesterday afternoon Kemp drove his car out of Khyber Pass Road into Symonds Street and disregarded the signal of the traffic officer cn dutv at the top of Symonds Street. The traffic officer noticed that accused's car was driven in an erratic manner. Later, the traffic officer got in front of the car and stopped it. Kemp was arrested and later examined by Dr. C. H. Tewsley, who that .although he was slightly affected by liquor, it was not a bad, case. “The medical certificate given in this case is the most cogent evidence I have,” said the magistrate. “It is certainly the weakest medical certificate I have ever e-een. It states that defendant was ‘mildly affected by alcohol.’ I suppose any man who takes a drink is mildly affected. Jt may be that being a stranger to Auckland he did not observe the traffic signal given him. The case is just over the borderline. It is one which does not call for a heavy penalty. Accused will be fined £o. I will not interfere with liis driving license.”
