DECISION GIVEN IN ACTION OVER SELICA DEPOSIT.

PLAINTIFF GRANTED DAMAGES BY COURT. (Special to the *' Star.”) AUCKLAND, August 23. Mr Justice Reed gave his reserved judgment to-day on a claim by Mrs Cecilia Linis Kunst, claiming £3OOO damages against William Ravage Tate, of Ashburton, for alleged breach of contract in respect to the purchase of thirty acres of glass-bearing sand at Awanui. It was alleged that as the result of negotiations with Tate, plaintiffs had broken off an engageme- t for supplying silica to the Australian Glass Company. The defence was that the option offered was never exercised, or in any case it was offered to the Southern Cross Glass Company, Tate not being liable. The judge said that he thought that plaintiff was entitled to recover damages against defendant. He deferred an assessment of the amount, suggesting settlement on the basis of carrying out the original contract, modified or otherwise, as carries agreed.
