HER MOTHER’S WILL.
LUMP SUM AWARDED. Mr Justice Adams to-day settled a family dispute ovei the will of Mrs Eliza Armstrong, who died at Southbridge, leaving about £BOO, divided amongst her twelve children. One of them, Miss Annie Louisa Armstrong, was given more than any of the others, but she claimed that, as she had stayed with her mother and nursed her, she should receive still more, and she applied for further provision under the Family Protection Act.
His Honor made an order that Miss A. L. Armstrong should receive a lump sum of £75 iu addition to her legacy of £9O. and her costs. £lO 10s. and disbursements and witnesses' expenses, to be fixed by the Registrar. The order provided that the shares of all the other beneficiaries, except Robert George Armstrong. John Wright Armstrong, Selwyn Armstrong and Charles Armstrong, should be included in the incidence of the order, which means that all of the other daughters and two of the sons are excluded from contributing to Miss A. L. Armstrong’s additional share of the estate.
Mr E. W. White appeared for Miss A. J,. Armstrong and Mr J. H. Upham for Robert George Armstrong, trustee under the will, as defendant.
