JURY DISAGREES.

NEW TRIAL FIXED. James Reynold Horne, a Dunedin chemist, in the Supreme Court yesterday, before Mr Justice Adams and a common jury of twelve, was charged : On November 7. 1921, at Timaru, unlawfully killed Violet Ada Atkins and thereby committed the crime of manslaughter. On October 7, 1921, at Dunedin, unlawfully used an instrument | or other means upon Violet Ada Atkins with intent to proclire her miscarriage. Air A. O. Hanlon, of Dunedin, with ! him Air C. S. Thomas, of Christchurch, appeared for prisoner. Air A. T. Donnelly, Grown Prosecutor, j conducted the case for tho Crown. Air Hanlon’s address to the jury, ; which lasted fifty minutes, was con--1 eluded at 3.8 p.m. JURY DISAGREES The jury retired at 3.45 p.m. At 5.27 n.m. the jury returned. Th© foreman asked if the Crown could call the nurse mentioned in the case, and if she would have to answer all quesi tioTjs put to her. His Honor said that if the depositions before them that day were true the nurse had boon a party to the offence, and as such could bo indicted, so that she could not, as a witness, bo forced to give evidence that would . incriminate her. The foreman stated that the jury had not readied a decision. They then ! again retired. Tho jury returned at 8.5, when the foreman announced that no verdict had been arrived at, and that; there was no ; possibility of a decision being reached. The jury was then discharged. His Honor granted th© Crown's application for a new trial to commence on Monday. February 27, at 3 0.30 a.m. Bail was allowed as before, two surtetieV, of £SOO each.
