ALLEGED UNLAWFULLY KILLING.
THE GUNTHER CASE.
[Per Press Association.] WELLINGTON, November 8. At the Magistrate's Court to-day, Edward Francis Moffltt was charged with unlawfully killing George Gunther on October 31- The evdeuce was to tho effect that the deceased, who had been drinking was admitted to the hospital with tin 8i inch fracture in his skull, and died next day. Dr Fyffe stated that there were no external marks of violence, and other witnesses said that the deceased was under the influence of drink and accosted Moffitt, who told him to go away and then struck him the deceased in falling striking, a win-dow-sill. At the inquest the Coroner's verdict was that death was caused by a fracture of the jtkull, but he was unable to say whether that was due to a fall or not. As far as Moffitt was concerned the civsc was a pure misadventure. After hearing a repetition of the evidence the accused pleaded not guilty and reserved his defence. He was committed for trial, bail being allowed.
