THE BEAUTY BUSINESS.

JUDGJIEXT FOE DEFENDANT. The " beauty business " case was continued at the Magistrate's Court this morning before Mr T. A. B. Bailey, S.M.

The case was one arising out o* a claim by Eva Mabel Emerson against Hemsley Burnett, Limited, a " beauty specialist," for £25 for breach of an agreement alleged to have been made b f y the defendant to initiate the plaintiff into the mysteries of face massage, ecalp massage, hair-dressing, shampooing, manicuring, the making up of '"switches," '"fronts," " transforations," and otlier descriptions of hair work, and also the making of pomades and other preparations. The plaintiff further claimed the sum of £25 from the defendant as damages.

Mr Alpers appeared for tlie plaintiff, and Mr Hunter for the defendant. After hearing legal argument from both counsel at some length 011 the question of non-suit, the Magistrate said that, having heard the evidence of both parties, he would have to decide against the plaintiff and: enter a nonsuit on the grounds that tlio contract sued l upon had not been under seal. In any case he would have decided against the plaintiff on the merits of the case. Mr Alpers protested against the Magistrate expressing any opinion on the merits of the case, as lie (Mr Alpers) had not yet called rebutting evidence which lie had to provo his allegations as to the mis-statements made by the witnesses for the defence. He had witnesses waiting who could prove the laying before the Court of a tissue of mis-statements. He snid that with a full knowledge of how serious the statements he made were. Under the circumstances he considered himself justified in protesting against any comments being made on the merits" of the case.

Mr Hunter contended that judgment should bo entered for the defendant on a second non-suit.

The Magistrate said that there was a lot in what Mr Hunter said, lie felt that no would bo justified in entering judgment for the defendant, with costs, on tho ground that that was a second non-suit. He would make no comment on tho merits of tho case.
