A PARTNERSHIP DISPUTE
Frederick Charles Thompson claimed repayment of £100, injunction, and £300 damages, from Thomas Dean.
Mr Harper, instructed by Messrs* Maude ami Harman, appeared for plaintiff, and Mr Stringer for defendant.
The Ssliitcnier.t of claim was to the effect that on June 2, 1802, plaintiff entered into partnership with the defendant, in Christchurch, in the business of land and commission, agents. At that time, the defendant was also engaged in the business of a produce merchant, in Cliristchurch ; and in September, 1902, the defendant entered into a 'verbal contract with the- plaintiff to admit him into partnership in this business also, on condition of each party paving in the sum of £100. The plaintiff paid his £100, but defendant did not, and. on Nov. 28, repudiated the contract. The plaintiff now asked judgment for the repayment of the £100, for "£3OO damages for 'breach of contract, for a decree of dissolution of partnership, and for an injunction to restrain defendant from dealing with* the partnership assets of the business.
The statement of defence was to the effect that the £100 had been paid into the land and estate business, and had been lost on tho partnership account.
