Tuesday, Oct. 6. (Before Mr H. W. Bishop, 8.M., Mr E. E. Good, J.P., Mr A. Todd, J.P., Captain Parsons, J.P., and Mr Wallace, J.P.) Assault. — James O'Connell was charged by James Baker with having assaulted him at Ohoka on Sept. 24. Mr Hehnore for prosecutor, Mr Donnelly for defendant. Evidence showed that the altercation occurred over the impounding by prosecutor of a pig belonging to defendant's father. Prosecutor was on his own property at the time. He alleged that defendant struck him, cutting his lip, and a fight ensued, which lasted five minutes. Prosecutor had to obtain surgical attention to his injury. The defence was that prosecutor struck the first blow, and caused the fight. The majority of the Bench considered the case fully proved, and inflicted a flue of £1, with costs £3, allowing a week for payment, half the fine to go to prosecutor. Civil Cases. — Miles and Co. v. W. M'Kae, claim 10s. Mr Fisher for plaintiffs, for whom judgment was given with costs. — Eainsey v. A. Shankland, A. Crearer and H. Cave, claim £5 17s. Mr Johnston for plaintiff ; Mr Helrnore for defendants. Adjourned .for a fortnight.— D. M'Kay v. K. Andersen, claim .£ls 10s. Adjourned for a fortnight. Claim foe Worrying Sheep.— James Ashworth, Saltwater Creek, sued Alfred Wagner, Amberley, for .£35 2s Bd, damage sustained through defendants' dog worrying sheep. The claim was made up as follows — Eight ewes in lamb and one hogget killed, £5 12s ; eighteen ewes in lamb torn, bitten and useless, £7 16s ; general damage to flock of 652 ewes in lamb at 8d per head, .£2l 14s Bd. MiBrown for plaintiff, Mr Fisher for defendant. Several witnesses were examined on each side. [Left sitting.]
