AtiLTSGED House Stealing.— Alexander M'Kee wa3 charged on remand with. stealing a horse, tbo property of William. Mai tin, of Victoria. Mr Pender stated thai, he had received a copy of a telegram from the Commissioner of Police in Melbourne, saying "Please release M'Kee, prosecution abandoned." He (Inspector Pender) understood that accused'n friends had paid the money, and the only thing left to do was to discharge the man. The Bench ordered the discharge of the accused, whi> left tho Court. Civil Cases. — Vale v. Duncan, claim J29 2a Gd ; adjourned to Feb. 9. — Cusden v. Munro, claim £6 183. Mr Cress well for def> ndant. The claim was for the balance of an account, the case having been adjourned from the previous day for the production of plaintiff's books. These failed to prove his case, and judgment was given for £'* 11s, the amount paid into Court by the defendant. Plaintiff was ordered to pay costs.— Rowe v. Walker, Penfold and Cartwright (Trustees of the Druids' Gala of 1890), claim £2 2s. Mr Beattie for plaintiff. Plaintiff, H. E. Rowe, Btated that he was a commission agent, and last year he waß appointed to arrange matters in connection with the last year's Gala Art Union. He did the work, and afterwards said to Stewart, the Chairman of the Art Union. Committee, that ho should charge them £2 2s for his time. Was afterwards offered 15s, and subsequently 255, which he refusf.d to take. Was a Druid, and had held important office amongst them. Was not engaged by defendants, but by Stewart. He had to supervise the work done by the other Druids. James Stewart, Chairman of the Art Union Committee, said that he did not engage Rowe, who was appointed on the voice of the meeting. Did toll him thai; if the Committee did not pay him Euiiicient he would pay him out of hie own pocket, Thought 25s to 30s would be quite sufficient for the work done. John Rhodes, Secretary to the Druids' Gala, produced the minute-book of the meeting at which plaintiff was appointed ; in this there was no mention of paying him. Mr Lane moved for a nonsuit on the ground thas no liability had been proved against the defendants. The Bench nonsuited the plaintiff, with the suggestion that he be paid what was fair.
