THE INFANTICIDE CASE.

MAGISTERIAL PROCEEDINGS.

THIS DAY.

| The formal Magisterial proceedings in r connection with this case were resumed J shortly after ten o'clock thiß morning. | ; The three prisoners were brought to town p I by the 9.35 a.m. train from Lyttelton, l ; and arrived at the Court-house in , | cabs shortly afterwards, when they > j were brought into the Court, and • ! provided with seats as at the Coroner's ' i inquest; the male accused, however, sitting ' i between the two females on this occasion. ; j Mr Stringer appeared for the defence, and, j like the reporters, had little more to do • ; than to compare his notes of the previous ■ inquiry with those being taken in the form i of depositions. Messrs E. Weßtenra, F. J. Kimbell and J. Hamilton were the presiding justices, and had an honorable sinecure, but Mr Weatenra's accustomed Magisterial eye on one or two occasions directed atten- : tion to circumstances which would not occur to the ordinary lay mind.

j Mr Inspector Pender at once began the ' case by calling the evidence precisely in the 8a me order as it was given on Friday, and in only one or two instances were there alterations in the evidence, and these were of no material difference from that pub- ; lished in Friday's issue. ! The following were the witnesses for the : prosecution whose depositions were taken, namely: —Mr C. B. Shanks and Dr Moor house. This witness added to his previous statement that, on the Sunday morning after Miss Flanagan's baby had been born, accused Flanagan had remarked that it was an unfortunate affair, but it was not the child's fault, and they must do the best for it. He asked the doctor if he knew of a nurse for it, when the doctor told Flanagan that he could use his (the doctor's) name in advertising for one, if he wished. Constable Stunner, EoseCowlin, Catherine Berry, Margaret Stout, Alice Barker, Walter John Wood, Frances Beatrice Coombs, and her mother, Jane j Coombs also repeated their evidence.
