Plaintiff said that on April 14, 1882, he backed two bills for £12 103 each, for E. E. Dransfield, to defendant. Dransfield failed to pay 1 hese, and plaintiff was sued for them. Witness paid £& lOs on account of these after judgment was given, and afterwards the balance by a three months' bill to Marks. These were not paid when due, but were paid some months later by Scarlett. Dransfield became a bankrupt about this time, and received his discharge three years afterwards by effluxion of time. The date of the bankruptcy was Oct. 18, 1884. Four years or so ago Dransfield came into some money, and arranged to pay all his ordinary creditors. Mr Slater said that he was acting for Dransfield at the time of the settlement with bis creditors. Witness went to Marks, who can neither read nor write, and asked to see the books in connection with the transaction. Some .£4O or .£SO was paid to Dransfield's various creditors. Marks stated first that nothing was due, but on examination he said he thought that about £l& 10s was due. Witness asked for the bills, which Marks said he could not find, and he arranged that .£lO was to be paid in settlement of all claims by Marks, and that in the event of the bills turning up the money was to be returned. Had since heard that the monpy had been returned to Dransfield. Defendant said that Scarlett paid the bills about twelve months after they -were dtie. Arranged with. Mr Slater to take £lO t and return the bills if they turned up. About three weeks since the bills turned up. Plaintiff and Dransfield met him in the street one Saturday, and said that they would come together on Monday to get the money. Scarlett came in, and witness told him that he had paid Dransfield.
