This Day. (Before John Ollivier, Esq., 8.M.) OBSTBtTOTING thb Bailway.— James Bain was charged with committing an aot whioh might have caused an obstruction to a rail* way, namely tethering a horse near the line. David Biohards, foreman platelayer, deposed that on Sept. 5, he found a horse tethered near the Morgue, on the Bailway reserve. If it had broken away it might have been killed on the line, and oaus«d a train to be upset. The Sergeant of Police informed the Benoh that the information was laid in consequence of complaints from and at the request of the Bailway authorities. Mr Bain had been previously cautioned by the railway people, and it apparently had no effeot. Fined 40s, and costs 7s. Oitil Cases.— Bouse v. Thomas Wishart. Judgment by default for olaim, £8 3s 6d and costs. — Philips v. Jones. The plaintiff stated that the suit was made against Mr Jones, the father of the debtor — the debtor being dead. Mr Joneß, Ben., he said, had guaranteed tbe debt. Defendant informed the Benoh tbat he would have been willing to pay the debt, although he could not in any way be' held responsible for the amount, as his son was twenty-six years of age at the time of his death ; but that plaintiff had angrily insisted on immediate payment -of the amount. Judument for defendant, with costs.
