(By Telegraph.—Press Association). WELLINGTON, Feb. 1.

The ease of William GoodfelloAv v. Albert Ernest Davy, organiser ol' the Democrat Party, was mentioned before Mr. Justice Ostler in chambers yesterday, when his Honour was making fixtures for the Supremo Court sessions which open on Monday.

Mr. Jackson, acting on behalf of plaintiff’s Auckland agents, said ho understood that an amended statement of claim had been filed and ho did not propose to ask for a fixture. Mr. Watson, for Davy, said he did not wish to see the case crowded out of the sessions.

His Honour remarked that the caso was obviously not ready for trial, and Mr. Watson would not be prejudiced if the question of granting a fixture was held over in the meantime.
