CLAIM FOR DAMAGES. THE CHATEAU ASSAULT. FARMER TO PAY £238. (By Telegraph.—Press Association). TAUMAHUNUI, Jan. 3.1. Reserved decision was given by Mi', lv. M. 3\ a I son, S.M., in favour oJ Richard Cohbe, former manager of the Chateau Tongariro, in the ease against Edward John Richard Seeker, farmer, of Hastings, in which plaintiff claimed £212/13/0 damages for assault.

Reviewing the evidence, the magistrate said he found the evidence generally established that shortly after midnight on September 8 Cohbe received two blows from defendant’s fisl, which caused head injuries. There were defendant’s own admissions that if plaintiff receive injury during the period of the fracas, such injury could only have conic from blows struck by defendant. He considered defendant hit plaintiff without any necessity for so doing and "’it'll an unreasonable degree of force.

The magistrate gave judgment for plaintiff for the full amount of the claim, £l2/13/6 hospital and medical expenses, and £2OO general damages; also Court costs and expenses £25/6/9.
