M.P.’s Privilege.
TRAFFIC -PROSECUTION. COURT'S POWER DOUBTFUL. (By Telegraph—Press Association). CHRISTCHURCH, Sept. 18. Unusual circumstances were disclosed in a traffic prosecution yesterday, when Jeremiah Connolly, M.P., was charged by the Waimairi County Council with overtaking a vehicle on an intersection when driving a motor-car. The question of privilege arose, as section 267 of the Legislature Act, 1908, stipulates that service on an M.P. during a session of Parliament shall be invalid, provided that tho member has not been guilty of a felony or misdemeanour.
The problem was overcome through counsel for defendant pleading guilty. The magistrate, Mr. E. D. Mosley, convicted and discharged defendant, stating that he had submitted to a penalty which it was doubtful if tho Court had the power to impose.
